1. ACCEPTANCE OF TERMS
By creating an MITD account, accessing NODES, or using any MITD-connected service,
you agree to these Member Terms & Conditions. If you do not agree, do not create an
account or use the services. These terms form a binding agreement between you and
Dark Space Depot LLC ("MITD", "we", "us"). You may accept these terms when you create
an account at sign-up, or at the point you create an account within a purchase or
checkout flow. In each case, the version of these terms in effect at the time of your
acceptance is recorded with your account.
2. ELIGIBILITY
You must be at least 18 years of age to create an MITD account and use the services.
By registering, you represent and warrant that you are 18 or older and that the
information you provide is accurate and belongs to you. Accounts found to belong to
individuals under 18 may be suspended or removed.
3. YOUR MITD IDENTITY
Your MITD account, profile, and associated identity information are designed to
function as a persistent digital identity within the MITD ecosystem. As the platform
expands, your profile may be recognized across multiple MITD-operated services,
applications, realities, experiences, events, devices, merchandise, and future
technologies as a consistent representation of your identity, preferences,
achievements, interests, access permissions, progression status, and participation
history.
Environments where your profile may be used include, but are not limited to:
- The NODES platform and its services
- Reality gateways and virtual environments
- Community spaces and social features
- Events and event registration systems
- Fashion experiences and wearable technologies, including MITD-enabled apparel
- Connected and emerging devices
- Space Mall services and commerce experiences
- Developer testing and preview programs
- Partner environments and sponsored realities
- Interactive installations and public experiences
- Mobile, desktop, web, wearable, and future device platforms
Your MITD profile is intended to remain associated with you across these experiences
whenever technically feasible and permitted by applicable law.
3.1 NAME FIELDS AND WHAT IS PUBLIC
Your MITD identity uses three distinct name fields, each treated differently:
- Legal name: Your legal full name (or, for company accounts, your legal business
entity name). This is collected solely to record your agreement to these terms and
to maintain the integrity of the membership. Your legal name is PRIVATE and is not
displayed publicly anywhere on the platform.
- Display name: A public name you choose and may edit. This is what other members see.
- Username (handle): A unique public @handle you choose, used to identify and link to
your profile. It may be edited subject to availability and reasonable limits.
You are responsible for ensuring your legal name is accurate, and for not selecting a
display name or handle that impersonates another person or organization, infringes
rights, or violates these terms.
3.2 LEGAL-NAME CHANGES AND RECORD RETENTION
Because your legal name is tied to your recorded agreement to these terms, changing it
is a reviewed process. When you request a legal-name change, the request is reviewed,
and upon approval you may be required to re-affirm your acceptance of these terms under
your new legal name before the change takes effect. We retain a history of legal-name
changes associated with your account as part of our agreement and recordkeeping
obligations. This history is private and handled in accordance with the Privacy Policy.
3.3 ACCOUNT PRIVACY AND CONTENT VISIBILITY
Your account has a visibility mode. You choose one when you create your account
and you can change it at any time in your account settings. The three modes are:
- Public. Your profile and the content connected to your account may appear in
the member directory, in search, and on other public discovery surfaces.
- Private (Limited). Your account is not listed in the member directory and is
excluded from public discovery surfaces. Members who are not your connections
see only a limited profile and may request to connect. Content you have
published remains present in public areas, but your name and profile
attribution are redacted from it.
- Private (Full). Your account and the content connected to it are removed from
public areas entirely. Neither your name nor the content itself remains
publicly visible or reachable.
3.3.1 CONTENT CONNECTED TO YOUR ACCOUNT
For purposes of this section, content connected to your account includes, but is
not limited to: media, text and written posts, items, worlds and spaces you have
created, interactive and experiential content, shared experiences, live events,
audio, pages, listings, and other digital property associated with your profile.
3.3.2 GOING PRIVATE TAKES EFFECT IMMEDIATELY
Switching your account to a private mode applies at once across every item
connected to your account. You may switch to a private mode at any time, at no
cost, regardless of membership level.
Making your account private removes your content from public areas going
forward. It does not retrieve copies that others have already saved, recorded,
or shared elsewhere; it does not delete the content from our systems; and it
does not affect records we are required to retain, including transaction,
safety, moderation, and legal records. Content necessary to complete a purchase,
order, event, or other obligation already in progress may remain accessible to
the parties to that transaction. Third-party caches and search engines may take
additional time to reflect the change.
3.3.3 RETURNING CONTENT TO PUBLIC
Moving content from a private state back to a public state is available to all
members. You may return your content as a whole, or return individual items
selectively while other items remain redacted or hidden. Both paths are open to
every account regardless of membership level, and both are paid for in
experience (XP) as described below. Premium membership does not purchase access
to your own content; it provides additional planning and progression tools, as
described in Section 10.
3.3.4 REPUBLISH COST AND XP ALLOCATION
Returning content to a less restricted state — from private to public, or from
Private (Full) to Private (Limited) — costs experience (XP). Each item carries a
republish counter that increases every time that item is republished, and the XP
required for that item rises as its counter rises. This exists to keep shared
spaces, events, and discovery surfaces stable for other members.
You choose how your XP is applied. You may direct earned XP toward a full
unlock, which returns your content as a whole, or toward one or more specific
items or sections, which returns those first. Directing XP at an individual item
returns that item sooner, because less XP is required to complete it. Unlocking
your content item by item requires more XP in total than a single full unlock.
Either path is available to you, and you may choose whichever suits you.
Every XP allocation must be selected and confirmed by you before it takes
effect. XP is never spent automatically. All members may enable XP Spend Review
in member settings at any time, which presents a review of the allocation and
its effect before the spend is committed.
XP that has been spent or directed toward an unlock is final. It cannot be
refunded, reversed, transferred, or reassigned to a different unlock, and it is
not returned if you later make the content private again. Progression in MITD
moves forward only.
XP is earned through participation in MITD and cannot be purchased. Purchases
made in MITD stores may earn credits or other rewards, but XP is not sold and is
not granted in exchange for payment. Current XP rates and thresholds are shown
in the product and may change. If you do not have the XP required, the item
remains in its current state until you do.
3.3.5 SCOPE OF THESE SETTINGS
Privacy and visibility settings control public discoverability and display. They
do not change how we handle your information internally, which is governed by
the Privacy Policy.
3.3.6 NO GUARANTEE OF ABSOLUTE PRIVACY
The privacy controls described in this section are enforced by our systems and
we work to keep them accurate. No connected system, including ours, can
guarantee that content is never seen by someone you did not intend. Software can
fail, be misconfigured, or behave in ways not anticipated; other members can
capture, record, or repeat what they have already been shown; and we may be
required to disclose information by law.
You should therefore treat any content you upload, create, transmit, or share
through MITD as content that may become visible to others, whatever visibility
settings are applied to it. If a piece of information must never be seen by
anyone else under any circumstances, do not place it on MITD, and consider
whether creating an account is appropriate for your needs at all. Your privacy
settings express your intent and we honor it; they are not a guarantee of
secrecy, and nothing in this section should be read as one. This section is
subject to the disclaimers and limitation of liability in Section 19.
4. ACCOUNT RESPONSIBILITY
Because your MITD account may be used across multiple interconnected systems, you
agree to treat your credentials and identity with the same care you would give to
other important personal accounts. You are responsible for:
- Maintaining the confidentiality of your login credentials
- Protecting access to your account and any connected devices
- Ensuring information associated with your profile is accurate
- Promptly reporting unauthorized access or suspected misuse
- Maintaining appropriate conduct while using MITD-connected services
Actions taken through your account may be attributed to your profile and identity
within the MITD ecosystem. You are responsible for all activity that occurs under
your account unless and until you report it as unauthorized.
5. ACCEPTABLE USE
You agree not to:
- Use the services for any unlawful purpose or in violation of these terms
- Attempt to gain unauthorized access to systems, accounts, or data
- Interfere with, disrupt, probe, or overload the services or infrastructure
- Manipulate, falsify, or exploit progression, achievements, experience points,
referrals, codes, or any reward or unlock mechanism
- Create accounts through automated means, or operate multiple accounts to abuse
rewards, referrals, or access systems
- Impersonate any person or misrepresent your affiliation
- Upload or transmit harmful, infringing, or unlawful content
- Reverse engineer, copy, or create derivative systems from MITD technology except
as permitted by law
We may suspend, restrict, reset progression for, or terminate accounts that violate
these terms or that we reasonably believe are engaged in abuse or fraud.
Your use of MITD is also subject to the MITD Community Guidelines, which
describe expected conduct in more detail and are part of and incorporated into
these terms.
6. PROGRESSION, REWARDS, AND VIRTUAL ITEMS
Experience points, levels, titles, avatars, badges, unlocks, codes, referrals, and
similar features are part of the MITD experience and have no monetary value, are not
transferable except where expressly permitted, and may be adjusted, reset, expired,
or removed to maintain fairness, correct errors, or address abuse. Where you purchase
goods or services, applicable purchase terms will govern those transactions.
Rewards and unlocks are earned through achievement and participation, not through
chance, wagering, or random-draw mechanics. Digital items, skins, themes, avatars,
and similar virtual goods are LICENSED to you for use within the MITD ecosystem, not
sold or owned, and the license is personal, limited, and revocable as described in
these terms. Any collectible, merchandise, or marketplace item offered through MITD is
provided for enjoyment and participation and is NOT offered or to be construed as a
financial instrument, security, or investment, and no guarantee of value, resale value,
or future availability is made.
7. ACCOUNT CREATION AND EMAIL VERIFICATION
When you create an MITD account, we ask you to verify control of the email address you
provide. Verification may be completed through a secure link sent to your email or
through a short verification code we provide, at our option. Verification links and
codes are time-limited and expire a short time after they are issued, and the number
of attempts may be limited. Until your email is verified, your account may have limited
functionality, and certain features, purchases, rewards, or access may be unavailable
or restricted until verification is complete. You are responsible for providing an
accurate email address that you control.
8. PRE-LAUNCH ACCOUNTS
MITD accounts may be created before the wider MITD platform and its services are
generally available. If you create an account during this pre-launch period, your
account, profile, experience points, progression, and purchase and order history begin
accruing from the time of creation and are preserved and associated with your account.
The timing of platform activation and general availability is not fixed, and we do not
promise or guarantee any particular activation date. Accrued data is retained and is
intended to be available to you when activation occurs, subject to these terms, the
Privacy Policy, and applicable law. Pre-launch features and systems may change before
general availability.
9. PURCHASES, ORDERS, AND GUEST CHECKOUT
Through the Space Mall and participating stores, MITD offers physical goods and related
items for purchase. Prices, availability, and product descriptions are set by the
applicable store and may change.
Guest checkout. You may make a purchase without creating an MITD account. When you
check out as a guest, we collect and store the information needed to process, fulfill,
and support your order, which may include your name, email address, an optional phone
number, and a shipping address, and we associate that information with your order. How
this information is handled and how long it is retained are described in the Privacy
Policy.
Claiming a guest order. After a guest purchase, we may email you a claim link that lets
you associate that order with an MITD account — either an existing account or one you
create at that time. The claim link grants the ability to attach the order, and any
items, records, or digital counterparts associated with it, to the account used to
complete the claim. Treat a claim link like a receipt that carries access: a person who
obtains the link may be able to claim the associated order. Do not forward or share the
link with anyone you do not intend to give it to. If you believe a claim link has been
exposed, contact us.
Shipping and fulfillment. Physical goods are shipped to the shipping region stated by
the applicable store, and any free-shipping threshold, shipping charges, and delivery
estimates are those stated by that store at the time of checkout. Shipping regions,
thresholds, and charges vary by store; the terms presented at checkout for your order
govern that order. Except where applicable law provides otherwise, risk of loss and
title for physical goods pass to you upon our delivery of the goods to the carrier.
Store terms. Each store in the Space Mall may publish its own terms and conditions
covering its products, orders, shipping, returns, and support. Where a store does,
those terms apply to your order in addition to these Member Terms, and placing an
order with that store is your acceptance of that store's terms. Store terms are made
available by the store at or before checkout, and it is your responsibility to read
them before ordering. Different stores may set different terms, so the terms that
apply are those of the store you are ordering from. To the extent a store's terms
conflict with these Member Terms as to your relationship with MITD, these Member
Terms govern; as to the sale itself, the store's terms apply.
Payment. Payments are processed by one or more third-party payment processors. We do
not store full payment card numbers. Your use of a payment method is also subject to
the terms of the applicable payment processor and your card issuer.
10. PREMIUM MEMBERSHIP
MITD offers an optional premium membership. An MITD account is free. Premium
membership is not required to create an account, to use NODES, to make
purchases, to earn or keep experience points and progression, or to control the
visibility of content you have created.
10.1 WHAT PREMIUM PROVIDES
Premium membership provides access to live and staffed services, expanded tools,
and content not available at the standard tier, which may include:
- Live services and experiences, including features supported by MITD staff,
hosts, and creators
- Specialized content, pages, and features, including live and AI-supported
experiences
- Entry into premium-designated content, spaces, and events
- Expanded messaging allowances
- Progression tools, including detailed views of your experience points (XP),
progressive unlock costs, and expanded spend reminders and confirmations
- Guides and resources on earning XP and progressing within MITD
- Expanded profile and presentation customization
Premium membership provides access, tools, and allowances. It does not purchase
progression, achievements, or unlocks, and it does not purchase access to
content you have created. XP is earned through participation, as described in
Sections 3.3 and 6.
Live and staffed services depend on availability and scheduling, and specific
sessions, hosts, events, or experiences are not guaranteed. Premium benefits may
be added, changed, or removed as the platform evolves. Where we materially
reduce the benefits of an active paid membership, we will provide notice.
10.2 TERM, RENEWAL, AND CONFIRMATION
Premium membership is available as a paid membership purchased for a fixed term,
and as lifetime membership, which is earned rather than purchased and is
described in Section 10.3. Paid premium membership does not renew automatically,
and no charge is ever made without your confirmation.
To continue premium services beyond your current term, you must agree to extend
them. You may do this at, near, or after the end of your term. If you do not
extend, your membership simply ends and your account returns to the standard
tier as described in Section 10.4.
Scheduled renewals. In your member settings you may schedule renewals in advance
by selecting a number of months or years. Scheduled renewals may not exceed five
years of renewals in total. Scheduling a renewal does not authorize an
unattended charge: each individual renewal still requires your confirmation
before any payment is taken. A scheduled renewal that you do not confirm does
not occur.
Extending beyond five years. When your scheduled renewals reach the five-year
total, or at any point before, you may choose to add further time. This is a
manual choice you make; renewals are never extended automatically on your
behalf.
Changes and cancellation. You may change or remove scheduled renewals at any
time in your member settings. Because no charge occurs without confirmation,
removing a scheduled renewal before you confirm it means no payment is taken.
Prices are those presented to you at the time you confirm each term.
10.3 LIFETIME MEMBERSHIP
Lifetime membership is an achievement, not a product. It cannot be purchased,
and no payment of any kind grants it or improves your standing toward it. It is
awarded to members whose participation and contribution to MITD meet the
criteria in effect at the time of the award. Lifetime membership is a goal
members can work toward through their actions on the platform.
How it is awarded. Lifetime membership may be triggered when an account meets a
stated threshold, and may also be granted by MITD administrators to accounts
that meet the criteria. Criteria are set by MITD and are evaluated against
system records, which may include:
- No sustained or unresolved negative reports against the account
- A specified amount of experience points (XP), which varies
- Content created, provided, or manifested through MITD platforms
- Other measures of participation and contribution that MITD may apply
Criteria, thresholds, and the XP amount required are variable and may change at
any time without notice. Meeting any criterion, or all of them, does not entitle
you to lifetime membership: awards are made at MITD's discretion, and MITD may
decline to make an award, pause awards, or discontinue lifetime membership
entirely at any time. Conduct that disrupts MITD systems or that affects other
members negatively may disqualify an account from lifetime membership
altogether, regardless of XP, contribution, or any other criterion met.
Attempting to manipulate, farm, or exploit the criteria is a violation of
Section 5 and disqualifies an account.
What it includes. Lifetime members receive premium membership as described in
Section 10.1 for as long as their MITD account remains active and in good
standing and we continue to offer premium membership, with no further payment,
term, or renewal confirmation required. Lifetime membership also carries
recognition and benefits designated for lifetime members, which may include a
permanent lifetime badge or title, designated avatars or presentation options,
early access to features, and invitations to lifetime-member content, spaces, or
events. These benefits are personal to your account and are not transferable.
Duration and standing. "Lifetime" refers to the life of the membership program,
not to a perpetual guarantee. Lifetime membership does not survive termination
of your account under Section 18, and does not obligate us to maintain any
particular feature, benefit, or service indefinitely.
Lifetime membership is held on the condition of continued good standing. A
lifetime member whose conduct disrupts MITD systems or affects other members
negatively, who violates these terms, or who obtained the award through
manipulation or misrepresentation may lose lifetime benefits, designated status
and recognition, access to specific features, or access to the account itself,
up to and including suspension or termination under Section 18. Lifetime status
does not exempt an account from these terms or from any enforcement action
available under them. If we discontinue lifetime membership as a program, we
will provide notice to affected members.
10.4 WHEN PREMIUM MEMBERSHIP ENDS
If your premium membership ends, is not extended, or is terminated, your account
returns to the standard membership tier. Premium-only tools, services, and
expanded allowances are no longer available, and standard tier limits apply.
Ending premium membership does not affect your XP, levels, titles, achievements,
progression history, purchases, or orders, which remain associated with your
account. Content you have returned to public using XP remains in the state you
set it. You do not need premium membership to make your account or your content
private at any time, as described in Section 3.3.
10.5 REFUNDS
Except where required by applicable law, membership payments are non-refundable,
including for partial terms and for periods during which you did not use the
services.
11. DIGITAL COUNTERPARTS
Certain physical purchases are intended to include a digital counterpart — a digital
item recorded to your purchase, for use with your MITD character and avatar within the
MITD ecosystem. Where a physical piece was made only once, its counterpart is one of a
kind as well. Where several of a piece were made, your counterpart is still individually
recorded to you and to your specific purchase, rather than a generic item issued to
everyone who bought that product.
Pre-release. The digital counterpart feature is not yet released. When you make a
qualifying purchase before the feature is available, your purchase is recorded, and the
associated digital counterpart is intended to be delivered to your account after the
feature becomes available. We do not promise or guarantee any particular delivery or
release date, and nothing in these terms should be read as a commitment to deliver a
digital counterpart by a specific time. The availability, timing, form, and
functionality of digital counterparts may change, and the feature may be delayed or, to
the extent permitted by law, modified or discontinued.
Nature of digital counterparts. Consistent with Section 6, digital counterparts and
other digital items are licensed to you for personal use within the MITD ecosystem, are
not sold or owned, are personal, limited, and revocable as described in these terms.
They have no monetary value and carry no guarantee of value, resale value, or future
availability. A digital counterpart associated with a guest order may be claimed and
delivered to the account that claims the order, as described in Section 9.
Non-transferability. Digital counterparts are non-transferable. They cannot be sold,
traded, gifted, assigned, or otherwise transferred separately from the account that
holds them, and cannot be detached from that account and moved to another. A digital
counterpart moves only where an entire MITD account is transferred, and only where such
a transfer is expressly permitted by us. Any attempted transfer of a counterpart apart
from its account is void, and we may revoke counterparts involved in such an attempt.
Additional terms for digital counterparts are set out in the Digital Items Terms, which
are part of and incorporated into these terms.
12. INVITES, REFERRALS, AND CODES
Members may invite others or share signup codes where these features are available.
Referral and code rewards are subject to conditions, including verification and
minimum-activity requirements, and are granted at our discretion. Rewards obtained
through fraud, self-referral, fake accounts, or other abuse may be withheld or
reversed, and associated accounts may be penalized.
13. COMPANY ACCOUNTS
MITD offers company (organization) accounts in addition to individual member accounts.
Company accounts are subject to additional terms:
- Manual approval: Company accounts are reviewed and must be approved by MITD before
they are activated. At signup, a company provides its legal business name, a website,
and a short description for review. MITD may approve or decline a company account at
its discretion, and may request additional verification.
- Company badge: Approved company accounts display a company badge identifying them as
organizations rather than individual members.
- Authority to bind: By creating a company account, the individual doing so represents
and warrants that they are authorized to act on behalf of that company and to accept
these terms on its behalf.
- Accuracy and conduct: Company accounts must provide accurate business information and
comply with all member conduct rules. MITD may suspend or remove company accounts that
misrepresent themselves, are inactive, or violate these terms.
- Event and feature eligibility: Certain experiences, events, rewards, or features may
be designated for individual members only, and company accounts may be excluded from
them. Eligibility for any given experience is determined by MITD.
- Status changes: A company account that is declined or later removed will lose access,
including the ability to sign in, consistent with these terms.
14. FUTURE PLATFORM EXPANSION
MITD is an evolving identity and experience framework. As new technologies, realities,
services, devices, and partnerships are introduced, additional uses for MITD identity
systems may become available, and features, permissions, profile data, progression
systems, achievements, access credentials, wearable integrations, event systems, and
interoperability tools may change over time. Participation in future services may
require additional consent, updated agreements, or separate policies.
15. PARTNER AND SPONSORED ENVIRONMENTS
MITD may collaborate with partners, sponsors, creators, organizations, venues, brands,
educational institutions, entertainment companies, technology providers, and other
third parties to create integrated experiences. Where such integrations are available,
your MITD profile may be used to personalize experiences, determine access permissions,
synchronize progression, display achievements, verify eligibility, or provide
continuity between participating environments. We will not share personal information
beyond what is described in our Privacy Policy, permitted by your settings, or required
or allowed by law.
16. DIGITAL IDENTITY NOTICE
Your MITD profile is intended to function as a persistent digital identity layer within
the MITD ecosystem and participating environments. It is NOT a government-issued
identification document, is not guaranteed to be accepted in any particular environment,
and should not be relied upon as proof of legal identity unless explicitly authorized by
the applicable service, venue, organization, or jurisdiction.
17. PRIVACY
Your use of MITD is also governed by the MITD Privacy Policy, which describes how we
collect, use, and protect your information. By accepting these terms you acknowledge
the Privacy Policy.
18. SUSPENSION AND TERMINATION
We may suspend or terminate your account or access at any time for violations of these
terms, suspected fraud or abuse, legal requirements, or risks to the platform or other
members. You may stop using the services at any time. Certain provisions, by their
nature, survive termination.
19. DISCLAIMERS AND LIMITATION OF LIABILITY
The services are provided "as is" and "as available" without warranties of any kind,
to the fullest extent permitted by law. To the maximum extent permitted by law,
Dark Space Depot LLC will not be liable for indirect, incidental, special,
consequential, or punitive damages arising from your use of the services.
Without limiting the foregoing, you acknowledge Section 3.3.6, which states that
no connected system can guarantee that content is never seen by someone you did
not intend, and that privacy and visibility settings express your intent rather
than guarantee secrecy.
20. CHANGES TO THESE TERMS
We may update these terms as the platform evolves. When we make material changes, we
will update the version and effective date and may request renewed acceptance. Continued
use after changes take effect constitutes acceptance of the updated terms.
21. GOVERNING LAW
These terms are governed by the laws of the State of Florida, United States, without
regard to conflict-of-laws principles. Any disputes shall be subject to the jurisdiction
of the state and federal courts located in Florida.

By signing at sign-up, or by creating an account within a checkout flow, you acknowledge
that you have read, understood, and agree to these Member Terms & Conditions and the
MITD Privacy Policy, and that you are at least 18 years of age.
