MITD Digital Items Terms

These Digital Items Terms describe how digital items — including digital counterparts to physical purchases — work within the MITD ecosystem. They are part of and incorporated into the MITD Member Terms & Conditions, and are read together with the Privacy Policy. Where these terms and the Member Terms address the same subject, both apply; the Member Terms govern any direct conflict.

1. What a Digital Counterpart Is

Certain physical purchases are intended to include a digital counterpart: a digital item recorded to your purchase, for use with your MITD character and avatar within the MITD ecosystem. A digital counterpart is tied to the purchase it accompanies and to the account that holds it.

Where a physical piece was made only once, its counterpart is one of a kind as well. Where several of a piece were made, your counterpart is still individually recorded to you and to your specific purchase — it is not a generic token issued to everyone who viewed or bought the product. Uniqueness, where it applies, describes that record only: it does not make a counterpart a financial instrument, a collectible with any guaranteed value, or a tradable asset.

2. Pre-Release Status

The digital counterpart feature is not yet released. When you make a qualifying purchase before the feature is available, your purchase is recorded now, and the associated digital counterpart is intended to be delivered to your account after the feature becomes available.

We do not promise or guarantee any particular delivery or release date. Nothing in these terms, on the storefront, in a cart, at checkout, on a receipt, or in any preview should be read as a commitment to deliver a digital counterpart by a specific time. The availability, timing, form, appearance, and functionality of digital counterparts may change before and after release, and the feature may be delayed or, to the extent permitted by applicable law, modified or discontinued.

3. License, Not Ownership

Consistent with Section 6 of the Member Terms, digital counterparts and other digital items are licensed to you for personal use within the MITD ecosystem. They are not sold or owned. The license is personal, limited, and revocable as described in the Member Terms. Digital items have no monetary value and carry no guarantee of value, resale value, or future availability, and are not offered as a financial instrument, security, or investment.

Digital counterparts are non-transferable. They cannot be sold, traded, gifted, assigned, or otherwise transferred separately from the account that holds them, and they cannot be detached from that account and moved to another. A digital counterpart moves only where an entire MITD account is transferred, and only where such a transfer is expressly permitted by us. Any attempted transfer of a counterpart apart from its account is void, and we may revoke counterparts involved in such an attempt.

4. Purchases Made Without an Account, and Claiming

You may make a qualifying purchase without an MITD account. Where you do, any associated digital counterpart is held against your order and may be claimed and delivered to the account that completes the claim, using the claim link described in Section 9 of the Member Terms. Anyone who obtains a claim link may be able to claim the associated order and its digital counterpart, so treat the link as you would a receipt that carries access, and do not share or forward it to anyone you do not intend to give it to.

5. Use Within the Ecosystem

Digital counterparts are intended for use with your MITD character, avatar, and related features. Their behavior and where they can be used depend on the features MITD makes available, which may change over time. A digital counterpart is not guaranteed to be usable in any particular environment, reality, event, or partner experience, and its use is subject to the Member Terms, including the acceptable-use and progression provisions.

6. Adjustments, Errors, and Abuse

As with other progression and reward features, we may adjust, reissue, correct, or revoke digital items to fix errors, maintain fairness, or address fraud or abuse. Where a purchase is refunded, reversed, or found to be fraudulent, any associated digital counterpart may be withheld or revoked.

7. Changes to These Terms

We may update these Digital Items Terms as the feature develops. When we make material changes, we will update the version and effective date. Continued use after changes take effect constitutes acceptance of the updated terms.

8. Governing Law and Contact

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Questions may be directed to Dark Space Depot LLC through the contact methods provided within the MITD platform.
